Eligibility to Purchase

The purchase of merchandise through Coleman Douglas Pearls Ltd ("CDP") is strictly limited to parties who can lawfully enter into and form contracts on the Site in accordance with English law.

In order to make purchases through the Site, you will be requested to register and provide your personal details. In particular, customers must provide their real name, phone number, e-mail address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide payment details. You represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the billing information provided.

The Site is available only to individuals and others who meet the CDP terms of eligibility, who have been issued a valid credit card by a bank acceptable to CDP, whose applications are acceptable to CDP and who have authorised CDP to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise which they purchase see Payment section. Purchases made on the site are for the personal or gift use of the buyer only and are not to be used for re-sale, commercial purposes or any other commercial benefit.

Moreover, by making an offer to purchase merchandise, you expressly authorise us to:

Perform credit checks and, where CDP feels necessary,

To transmit or to obtain information (including any updated information) about you, to or from third parties from time to time, including but not limited to your credit-card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction).

To authenticate your identity.

To validate your credit card.

To obtain an initial credit card authorisation

To authorise individual purchase transactions.

Orders Policy

All orders are subject to acceptance and availability.

CDP offers products for sale that are in stock and available for dispatch from our distribution centre. If for any reason items that you order are out of stock or subject to a delay, we will try to contact you at the email address you provided when placing your order. If we cannot contact you or receive no response to our email, we will continue to process the remaining items on your order. We will not supply a substitute product without your express authority.

Please be aware that we may be unable to deliver selected merchandise due to production problems or quality check issues identified when we receive this merchandise into stock. In these circumstances we will notify you by email and refund the Advance Payment to your credit card within thirty days of being advised that merchandise has become unavailable.

Please note that on occasion certain products that are in particularly high demand will sell out. Should this be the case, please email our Product Advisor at orders@pearls.co.uk who will be happy to add your details to the waiting list and contact you should the item again become available to arrange payment details. Please first make sure you register your details with us.

Acceptance of your Order

Once you have made your choice and your order has been placed; you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order.

Unless you cancel your order in accordance with our Cancellation Policy below, acceptance of your order and completion of the contract between you and CDP will be perfected when we despatch the goods to you. The sale contract is therefore concluded in London, England and the language of the contract is English.

We reserve the right not to accept your order in the event for example:

That we are unable to obtain authorisation for payment.

That you do not meet the eligibility criteria set out above.

That the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn. Furthermore, we may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion.

The content of our web site is presented, "as is", and we do not guarantee its accuracy, whether explicit or implied. We reserve the right to amend errors, make changes to our web site, and withdraw any part of our site or to update product information at any time if we consider it necessary.

We will not be liable to you or any third party by reason of our withdrawing any merchandise from the site. Whether or not that merchandise has been sold, by removing, screening or editing any materials or content on the site, by refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Payment

Prices shown on the site are in GBP Sterling and are inclusive of VAT. All prices and offers remain valid as advertised from time to time. The price of a product displayed on the website at the time the order is accepted and will be honoured. If you are buying from outside the UK, you will also incur carriage costs and any duties levied by the jurisdiction to which you have specified delivery. The final price for overseas customers will be calculated in accordance with the exchange rate applicable on the day your credit card company processes the transaction. Payment can be made securely online with Visa, MasterCard and American Express. You may also place your order through telephone or fax [Please refer to the section How to Place your order on the Customer Care page]. The credit/debit card that is being used must be yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment, we will not be liable for any delay or non-delivery of your order. We also reserve the right to cancel your order. For first time online customers, we may request that shipping be to the credit card billing address only.

By submitting an order to us through our web site you represent and warrant that the payment details provided on your order are valid and correct and that when your order is accepted and processed by us, payment will be made in full.

If the billing details for your order are the same as your delivery address details, by placing an order on the web site you confirm that you are the person referred to in the delivery address details. Otherwise, by placing an order, you confirm that you are the person referred to in the billing details.

We take all reasonable care to make our Site as secure as we can make it. All credit card transactions on this site are processed using a secure payment gateway. When the order is placed at our web site, credit card numbers are encrypted using 128 bit encryption, which is PCIDSS compliant. They are only decrypted after they reach our computer. They are not held in clear text on the web site or our customer database.

Given the unpredictability of technology and the online environment, Coleman Douglas Pearls make no promise that our web site will be uninterrupted or entirely error free, or free of viruses or bugs or compatible with any other software or material. Accessing the web site is entirely at your own risk. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control.

Delivery

We aim to deliver your chosen items to the place and person of your choice, in perfect condition and in the shortest possible time.

Most orders will be dispatched within 7 working days from receipt of your acknowledgement email, subject to credit clearance, address verification and availability of items. We will contact you if there is a delay or items are out of stock.

UK Delivery

Delivery to addresses within the UK costs £10.00 and will be delivered by Royal Mail special delivery service within 7 days.

Parcels will need to be signed for in person so please state as delivery address; an address at which you will be, this could be your home or work address. If you are not at home when your parcel is delivered, Royal Mail will leave a calling card and you will be able to collect your parcel from your post office.

International Delivery

Please also note that any duty and taxes incurred in the country of destination are the responsibility of the customer.

Delivery to overseas addresses costs:

Postal tracked and signed items delivered within Europe £25.00

Signed for or tracked only items delivered anywhere else in the world by the post office £35

Should you wish to use FedEx please let us know the cost is approximately £95.00 in which case it will be delivered by courier within 9 days depending on your destination.

Parcels will need to be signed for in person so please ensure that the delivery address you give us is an address at which you will be during working hours (home or work). If you are not at home when your parcel is delivered, the Postal Service will alert you, if you chose Courier service the Courier Company will leave a calling card and you will be able to reschedule your delivery for a time more convenient to you.

Orders in Transit - Insurance

CDP insures each purchase during the time it is in transit until it is delivered to you. You will be asked to sign for any goods delivered at which point responsibility for your purchased goods passes to you.

Orders in Transit - Tracking your order

You can check the current status of your shipment by emailing us at orders@pearls.co.uk and supplying us with the unique tracking number which we will have provided you with by email. We will then track your shipment for you.
CDP will store a record of your transactions for a minimum of one year. Please note that for your security only a record of your transaction is kept at CDP or on the CDP web site, your credit card details will not be held at CDP or the CDP web site.

Unsuitable jewellery purchased online through our web site will need to be shipped back to us for return or exchange within 3 working days of receiving the item. Please note that we are unable to accept returns or exchanges on pierced earrings and tailor made or specially commissioned items.

We strongly advise all customers to check their purchase thoroughly upon delivery before removing any attached tags or disposing of any original packaging.

Upon receipt of an order, if any item has been received with no tags or faulty the customer should notify us (by phone or email) within 48 hours of receipt if they wish to return the item.

The item you return must be in new, unused, and unworn condition, with all the original packaging and tags still attached. We do not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser.

Before you return something you must notify us within 48 hours of receiving an item and obtain a Return Authorisation Reference [RAR] number by emailing us at orders@pearls.co.uk, All returns from any particular order need to be returned in one shipment.

Please include your original receipt in the returned parcel. You must write your Return Authorisation Reference [RAR] number on the receipt, and on the label of the returned parcel. Any returned items that are not accompanied by an official reference number will not be accepted.

We can only exchange an item for the same item in a different size, subject to availability or a similar item. We are unable to process any exchanges for a completely different item. Exchanged items can only be dispatched after the returned goods have been received and undergone a quality control check.

Returns received after the 5 working days’ time frame are accepted at the discretion of CDP and can only be refunded with a 'store credit note' which can be used online or in our shop.

Exchanges received outside the 5 working days timeframe as stated above are also subject to product availability and the customer will incur any shipping costs for such exchanges. Any further returns of exchanged items outside the stated time-scales will again be at the customer's cost for shipping and refunded only as a store credit.

It is advisable to send returned items by Royal Mail special delivery post, Tracked and Signed for postal service / DHL or FedEx and keep your proof of postage certificate, as we cannot be responsible for goods lost or damaged in transit.

Please note that we do not accept liability for returned goods if you do not return them to us via Royal Mail Special Delivery, Tracked and Signed for postal delivery, DHL or FedEx.

Please note that all postal or courier costs for returned goods are the customer's responsibility and will be reimbursed by us only in the case of faulty or incorrectly supplied goods.

If you wish to receive a refund we will re-credit the original purchaser's credit card for the sum paid less any taxes, duties and postal costs.

Please be aware that international customs duties and sales taxes, however they have been incurred, are NOT refunded for shipments outside the European Community (EU).

In the event of an exchange please be aware that you will be required to pay any difference in cost and any additional carriage, shipping, taxes and import duties. Any unused credit will remain on your account until your next purchase.

Please note that all postal or courier costs for returned goods are the customer's responsibility and will be reimbursed by us only in the case of faulty or incorrectly supplied goods. Customers' statutory rights are unaffected.

Returns Policy for faulty goods

Same as above except that we request that all items are returned within 3 working days of the date you received your Return Authorisation Reference [RAR] number.

Returns Policy for Sale Items

Same as above except that we request that all sale items are returned within 3 working days of the date you received your Return Authorisation Reference [RAR] number.

Any items returned outside the above mentioned time frame are accepted at the discretion of CDP and can only be refunded as a store credit.

Gift returns

If you have received a gift from Coleman Douglas Pearls you can exchange it for credit to use at Coleman Douglas Pearls. This allows you to exchange your unwanted gift for another item by using this credit to purchase more suitable Coleman Douglas Pearls designs either online or at our atelier Coleman Douglas Pearls.  Please be aware that you will be required to pay any difference in cost and any additional shipping costs, taxes and import duties. Any unused credit will remain on your account until your next purchase.

How to proceed if you want to return or exchange an item

How to proceed if you want to return faulty goods

We request that all faulty items are returned within 3 working days of the date you received your Return Authorisation Reference [RAR] number by following the standard returns process detailed above.

Please note that faulty items will be accepted only if the goods are delivered to the customer damaged or there is a subsequent manufacturing fault within a period of 6 months after delivery. All items returned as faulty will be inspected and any items deemed subject to fair wear and tear will not be accepted as faulty.

Exchanges are possible if the item is available. We can only exchange faulty items for the same item in the same size, subject to availability. If you wish to exchange, please make your request clear when requesting your RAR.

Where possible items may be repaired on request but only where such items are deemed faulty and repairable. Repairs do not come with any guarantees.

Order Cancellation policy

You may cancel your order if it has not yet been dispatched. In the case of specially ordered designs, only if the process of making the design has not yet begun will we be able to cancel this order. However, there will be a cost associated with this as the online Payment Company will already have levied charges onto us, which we will not then be able to refund you.

If your order has been dispatched and the item is not a specially ordered design you will need to notify us within 48 hours of receiving the item which is not suitable and obtain a Return Authorisation Reference [RAR] number by emailing us at orders@pearls.co.uk. Refund policy

If you wish to receive a refund for items bought through our website, we will re-credit the original purchaser's credit card for the sum paid less any taxes, duties, internet payment charges and postal or shipping costs. Please note that we are unable to accept returns or exchanges on pierced earrings and tailor made or specially commissioned items.

Refunds to you will be made within 30 days of the date of cancellation notice. All undamaged, correctly returned products will be credited to the original purchaser's credit card including sales taxes for all EU country shipments excluding shipping charges. As previously stated, for shipments outside the EU countries, shipping charges, international customs duties and sales taxes are non- refundable.

Alternatively, you can request a CDP store credit that can be used against future purchase at Coleman Douglas Pearls either online or from our atelier Coleman Douglas Pearls.

Security policy

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.
